School agreement
1. Parties and acceptance
This agreement is between DXBE Limited (company number 8479537, NZBN 9429050841509), trading as Week by Week, 70 Somerset Terrace, Stoke, Nelson 7011, New Zealand (“Week by Week”, “we”) and the school or organisation that orders Week by Week (“the School”). It applies from when the School's first staff account is created or an order is placed, whichever is first, together with our terms of use and privacy policy. The person accepting it confirms they are authorised to do so for the School.
2. The service
We provide the Week by Week AI life and career coach to students who join with the School's codes, and a dashboard for School staff to manage access, view engagement and pay. We may improve and change features, but we will not materially reduce the core service while the School uses it.
3. Prices, credits and payment
The licence
- The School buys a licence for the whole school, on a monthly or a yearly plan. Every student at the School can join with the School's codes, and there's no limit on staff accounts. We don't count or charge per student.
- The licence size depends on the School's roll, taken from the School's latest roll return as published by the Ministry of Education, counting Years 9–13 where the published figures show them. For composite and area schools, and where no suitable roll is published, we agree the size with the School. We set the size when the School first orders, and we always tell the School which roll figure we used.
- We review the size at each yearly renewal on 1 February, against the latest published roll return. If the roll has moved into another band, we tell the School in writing beforehand, with the roll figure we used, and the new size applies from 1 February – for a yearly plan, from its renewal; for a monthly plan, from the first monthly payment on or after that date.
Prices
Prices are as shown on our pricing page. They are in NZD and exclude GST, and we issue GST tax invoices. A yearly plan costs the same as 10 monthly payments. Current prices:

AI credits and fair use
- Each licence includes a shared pool of AI credits for the School's students, as shown above: a monthly pool on a monthly plan, and a yearly pool on a yearly plan. We add the credits for a plan period once we receive payment for it – for a yearly renewal paid by 31 January, on 1 February.
- Fair use: each student can use up to 200 AI credits in their first 7 days after joining (a starter week, once per account, from the School's pool), then up to 60 a week (Monday to Sunday, New Zealand time), and any one account up to 1,000 credits a month.
- Speed limit: each account can use at most 30 AI actions in 10 minutes; tiny ones like follow-up questions count separately, up to 80.
- The school dashboard shows a warning when the School's AI credit pool reaches 80% and 100%. If the School adds an email address for these warnings, we also email it at 80% and 100%. Students can keep using AI until 110% of the pool. That extra 10% is free: we don't deduct it from later credits. At 110%, AI features pause for the School's students until more credits are added, and everything else keeps working.
- We never charge for usage. More credits only come with the next plan period or when the School chooses to buy an extra credit pack: on a monthly plan, in its dashboard, charged to the School's card; on a yearly plan, by asking us, and we invoice it. The pack's credits are added once it's paid.
- On a monthly plan, unused credits stay in the pool while the plan continues, up to one year's pool. On a yearly plan, each plan year starts with a new pool and unused credits from the year before lapse. When a plan ends, its pool ends too.
Monthly plan
- Paid monthly in advance by card through Stripe. The plan renews each month until the School cancels.
- The School can cancel at any time by email to hello@week-by-week.com. The plan then runs to the end of the month already paid for, and nothing more is charged. A month that has started isn't refunded.
- To switch from a monthly to a yearly plan, the School contacts us and we arrange it.
Yearly plan
- Paid by invoice. Each plan year runs to 31 January. If the School starts during the year, its first invoice covers only the time up to 31 January, at a proportional price, with the same share of the year's pool.
- When the School requests a yearly plan, it gives us a billing email address for its accounts team and its purchase order (PO) number, if it uses one. We send invoices to that address and show any PO number on them. Invoices are due within 20 days of the invoice date, except the renewal invoice (next point).
- The plan renews automatically for another plan year on 1 February. In late November, before the summer holidays, we email the School a reminder together with the invoice for the next plan year, due by 31 January – so a School that pays it on time starts Term 1 with its new credits.
- The School can cancel at any time by email to hello@week-by-week.com. If it cancels before 1 February, the plan ends on 31 January and isn't renewed, and the School owes nothing for the new plan year: we cancel the renewal invoice, or refund it if it has already been paid.
- Once a plan year has started, cancelling ends the plan at the end of that plan year (31 January). The fee for a plan year that has started is payable – including a renewal invoice that hasn't been paid yet – and isn't refunded, unless the law requires it.
Paying invoices and late payment
- The School can pay an invoice online by card on the invoice's payment page, or by bank transfer to the account shown on the invoice, quoting the invoice number. Our bank statement then shows us the payer's name, account number and payment reference, which we use only to match the payment (see our privacy policy). A bank transfer can take a few working days to reach us; credits are added once it has arrived (for a renewal, on 1 February).
- If an invoice or a monthly payment is more than 30 days overdue, we may pause AI features after giving notice.
When a plan ends
- AI features and editing are paused, but students can still log in and read everything for at least 120 days – for a School that stops at the end of the school year, that's at least until 31 March. If the School starts a new plan, everyone carries on where they left off.
- A student can keep their account by choosing a personal plan. The account then moves out of the School: the School no longer sees it, and the student's data stays with them.
- Otherwise, student accounts and their content are deleted 12 months after the School stops using Week by Week, unless the School or the student deletes them earlier (section 10).
4. Free pilot
A free pilot gives 5 students access for 1 month. Their AI credits come from a shared pool of 1,750, with the usual fair use for each student (up to 200 in their first 7 days, then up to 60 a week). The month starts when the first student logs in, not when the School signs up. No card or payment details are needed. The pilot ends automatically, and nothing is charged unless the School then chooses a plan; if it does, its students and their work carry over.
5. The School's responsibilities
- Share join codes only with students aged 13 or over for whom the service is appropriate, and stop codes that are no longer needed.
- Let students and their parents or caregivers know that the School uses Week by Week (we provide a template letter).
- Keep staff accounts secure and remove staff who leave.
- Make sure students know how to reach the School's pastoral and guidance support.
- Use the engagement information in the dashboard only to support students.
6. Privacy and data
- Students give their information directly to Week by Week under our privacy policy. Students don't need to give a real name or contact details to create an account; if they make a CV, they can choose to add contact details for employers.
- The School receives only engagement information (nickname, age, year level, dates of joining and last activity, credits used). The School's dashboard doesn't show student content, and we will not give it to the School unless the student agrees or the law requires it. Staff can set a temporary password for a student who is locked out. Whoever signs in with it has to choose a new password first, and the student can see the reset in their account. A student who keeps their account with a personal plan after the School's plan ends is no longer part of the School, and the School no longer sees their account (section 3).
- Our service providers (sub-processors) are listed in our privacy policy. We will tell the School before adding a provider that stores student content.
- Each party complies with the Privacy Act 2020 for the information it holds. We will tell the School without undue delay about a privacy breach affecting its students that is likely to cause serious harm.
7. Wellbeing and safety
Week by Week is not a counselling or crisis service. Nobody watches conversations in real time. Automated AI checks look for safety concerns in much of what students write, such as messages, answers, check-ins, wins, goals and habits. They can miss things. The AI coach is designed to respond to signs of serious distress by gently raising it and pointing the student to 1737, emergency services and a trusted adult such as the School's counsellor. Week by Week does not notify the School about individual students. The School remains responsible for its own pastoral care.
8. Confidentiality
Each party keeps the other's non-public business information confidential and uses it only for this agreement, unless the information is already public or the law requires disclosure.
9. Intellectual property
We own Week by Week, its software, content and name. The School may use Week by Week for its students during the plan. Students own what they write. The School allows us to use its name and logo inside Week by Week (for example on join pages) and, only with its written permission, in our marketing.
10. Ending the agreement
- The School can end the agreement at any time by cancelling its plan as set out in section 3, or by email; the plan then runs to the end of the current month or plan year (section 3). We can end the agreement with 30 days' notice by email. Either party can end it immediately if the other seriously breaches it and does not fix the breach within 14 days of being asked to.
- Fees already paid are not refunded, except for a renewal the School cancels before 1 February (section 3), where the law requires it, or where we end the agreement without the School being in breach – then we refund anything paid for the time after the agreement ends.
- When the agreement ends, AI features and editing are paused, but students can still log in and read their work for at least 120 days (section 3). Student accounts and their content are deleted 12 months after the School stops using Week by Week, unless the School or the student deletes them earlier, or the student has kept their account with a personal plan.
11. Liability
Both parties are in trade and the School acquires Week by Week for the purposes of a business. As permitted by section 43 of the Consumer Guarantees Act 1993, that Act does not apply between the parties. As permitted by section 5D of the Fair Trading Act 1986, the parties contract out of sections 9, 12A and 13 of that Act. Both parties agree this is fair and reasonable. Each party's total liability under this agreement is limited to the fees the School paid in the 12 months before the claim, except for liability that cannot be limited by law. Neither party is liable for indirect or consequential loss, or loss of profits.
12. Disputes
If a dispute comes up, both parties will first try in good faith to resolve it within 10 working days. If that doesn't work, either party may refer it to mediation in New Zealand before going to court.
13. General
- Neither party is liable for delays caused by events outside its reasonable control.
- We change prices at most once a year: we announce any change by 30 September, and it applies from 1 February the following year (for a yearly plan, from its renewal). We may change other parts of this agreement with 30 days' notice. The School can end the agreement before a change applies.
- Notices may be sent by email to the addresses each party uses for this agreement.
- We may transfer this agreement to a related company or to a buyer of the Week by Week business, and will tell the School if we do.
- This agreement, the terms of use and the privacy policy are the whole agreement about Week by Week. It is governed by New Zealand law.
